Our Commitment to Privacy
My PowerPak™ (“My PowerPak”, “we”, “us”, “our”) is the owner and operator of www.mypowerpak.com (the “Website”) and app.mypowerpak.com (the “Tool”). The Website and the Tool are collectively referred to as the “Products”. Your privacy is important to us and we are committed to protecting information that you may provide us through our Products or in email, texts, and other electronic messages between you and our Products.
Our Privacy Policy explains:
What information we may collect on our Products;
How we protect, maintain, use, and store this information; and
Under what circumstances we may disclose the information to third-parties.
This Privacy Policy does not apply to information collected on any other website operated by us or any third-party, including through any application or content (including advertising and the marketplace) that may link to or be accessible from or on the Products.
When you access our Products, you agree to this Privacy Policy. If you do not agree to this Privacy Policy, or to any changes we may subsequently make, you should not access the Products. This policy may change from time to time (see Changes to Our Privacy Policy below). Your continued use of the Products after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
If you have any dispute over the privacy of your information, the dispute is subject to this Privacy Policy and our Terms of Use, including limitation of liability, user disputes and release, and application of Minnesota law.
Conflicts Between this Policy and Laws and Regulations
When federal, state, or local laws and regulations require a higher level of protection for your Personal Information, they take precedence over this Privacy Policy. The specific requirements of this Privacy Policy apply unless disallowed by applicable laws or regulations.
Children Under 13
We have no way of distinguishing the age of individuals who access our Website or use our Tools. Anyone under the age of 13 may not use our Website or create an account using the Tools we provide. Accounts created for children under the age of 13 are only permitted if done so under the guidance of an adult legally authorized to act on behalf of the child. Information of a child under the age of 13, whose account is created by a legal guardian or parent, is stored in our secured servers. We do not knowingly collect information from children under the age of 13 that do not meet the aforementioned requirements. If we learn we have collected or received unauthorized personal information from a person under 13, we will promptly delete that information or revoke accessibility to their account as set forth below. How Do We Collect Information From You?
We collect the content, communications and other information you provide when you use our Products, including when you sign up for an account, create or share content, and message or communicate with us or others. We may collect personally and non-personally identifiable information:
Directly from you, your Champions, Guardians, Supporters or other users of your PowerPak Pages when using the Products;
Automatically as you navigate through the Products, including usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies; and
From third-parties, for example, our business partners, including our third-party service providers.
What Information Do We Collect?
We collect certain personally identifiable information from you when you search our Website, contact us, or report a problem with our Website. We collect certain personally identifiable information from you or your Champions, Guardians and Supporters when a PowerPak Page is created and as you and your Pak use the Tool. The personally identifiable information we, or our third-party business partners, may collect and store about you include:
Unique Identifiers such as name and date of birth;
Contact Information such as mailing address, billing address, email address, phone number;
Characteristics of a Protected Class such as age and gender;
Financial Information such as credit card number and transaction history;
Internet and Network Information such as IP address, device ID, browsing/search history, browser type and its settings, the third-party website you visited immediately prior to accessing our Products, the operating system you are using, domain name of your internet service provider
System Preferences such as in-app notifications and settings;
Geolocation Data such as the latitude and longitude of the device from which you use our mobile application;
Audio/Visual Information such as call recordings, photos, video or audio testimonials;
Site Experience Information such as search terms you use on our products, duration of your visits to our products, history of transactions, services you have viewed, as well as information about our communications with you.
We or our business partners also may automatically collect certain non-personally identifiable information when you visit our Products, such as the following:
Log Data: Servers may automatically record information when you use our Products, such as:
Your IP address;
The type of browser you are using and its settings;
The third-party website you visited immediately prior to accessing our Products;
The operating system you are using;
The domain name of your Internet service provider;
The search terms you use on our Products; and
The duration of your visits to our Products.
Cookie Data: Like many websites, we use “cookies” to obtain certain types of information when your web browser accesses our Products. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the sites or service providers’ systems to recognize your browser and capture and remember certain information. Some of the cookies we use are associated with your account with us (including personal information about you), and other cookies are not. We may use “session cookies” (cookies that last until you close your browser) or “persistent cookies” (cookies that last until you or your browser deletes them). Examples of the information we collect and analyze from cookies include your activity on our website, including the URL you come from and go to next (whether this URL is on our site or not). The cookies we use do not contain and are not tied to personally identifiable information. Web Beacons: Pages of our Products and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to do things like count the number of customers who have visited those pages or opened an email and for other related statistics pertaining to the use of our Products.
Experience Data: We may collect other information that is voluntarily provided by you from time to time if you provide comments to us or respond to surveys, polls, questionnaires, and/or registration forms contained within our Products. Such information may include personal preferences, opinions and experiences with our services, and may or may not be provided anonymously.
How Do We Share Your Information?
Your PowerPak Pages: When you share and communicate with others using our Products, you choose the audience for what you share. For example, when you post on My PowerPak, you select the audience for the post, such as members of your Pak, all of your Supporters, or a customized list of people from your Pak. Public information can be seen by anyone, on or off our Products, including if they don't have an account.
Content Your Pak May Share or Reshare About You: You should consider who you choose to share with, because people who can see your PowerPak Page, including your photographs and calendar, on our Products can choose to share your information with others on and off our Products, including third-parties outside the audience with whom you or your Pak have shared. For example, when you share information or send a message to specific Pak members, they can download, screenshot, or reshare that content to others across or off our Products, in person or via other communication vehicles. Also, when you comment on a PowerPak Page or react to an entry, your comment or reaction is visible to anyone who can see the other person's content, and that person can change the audience later.
What Do We Use Your Information For?
Any of the information we collect from you may be used in the following ways:
To personalize your experience - your information helps us to better respond to your individual needs;
To improve customer service - your information helps us to more effectively respond to your customer service requests and support needs;
To respond to your requests - such information, whether personally identifiable or non-personally identifiable, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of responding to your requests;
To send periodic e-mails - the email address you provide may be used to send you information, respond to inquiries, offer promotions, and/or respond to other requests or questions. We will use your contact information to contact you regarding your interest in our products and services, and to provide administrative notices and communications relevant to your use of our Products;
As we may describe when you provide the information; and
To identify and make improvements to the Products - we use your information and feedback we receive from you in a variety of ways, such as to analyze traffic on our Products (such as aggregated information on the pages visited by our users), which allows us to improve the design and content of our Products. We may use your information by itself or aggregate it with information we have obtained from others to analyze our Products.
When Do We Disclose Information to Other Parties?
With your consent: By accessing our Products or submitting information to us, you consent to our sharing your information with our service providers, partners, and affiliates, as necessary, to complete the requests you make. Under no circumstances will we share, rent or sell personally identifiable information for commercial purposes.
With Third-Party Providers: We may share your information outside of our organization with third-party providers to assist in providing support for our operations and Products. When you or a Pak member buy something from a seller the Marketplace within our Tools, the content creator or seller may receive your information in order to complete and fulfill the transaction, including your shipping and contact details, and if you are the purchaser, the content creator or seller may receive your payment information in order to complete the transaction. In addition, we may employ business partners to process personal information on our behalf for security testing of our systems based on our instructions and in compliance with this Privacy Policy. Under no circumstances will we share, rent or sell personally identifiable information for commercial purposes.
Email Communications: If you send us an email with questions or comments, we may use your email address to respond to your questions or comments, and we may save your questions or comments for future reference. We may email you:
If you request information about a product or service;
To provide you information relating to our Products that you are using (e.g., Product updates, customer support, etc.);
To provide information about our other products and services;
To inform you about updates to this Privacy Policy or our Terms of Use; or
Where you have consented to being contacted by email.
You may unsubscribe from receiving commercial email communications from us by emailing us at hello@mypowerpak.com. However, we reserve the right to send you transactional emails such as customer service communications on the Products you are using. For security reasons, do not send personal information, such as credit card information, or bank account information, to us by email.
Transfer of Assets: As we evolve our business, we may sell or purchase assets. If another entity acquires us or all (or substantially all) of our assets, the personally identifiable information and non-personally identifiable information we have about you may be transferred to and used by this acquiring entity. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third-parties
Where Required by Law: We reserve the right to disclose any information about you if we are required to do so by law, or if we believe that such action is necessary to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; or (c) protect or defend our legal rights or property or our Products.
How Do We Protect Your Information?
We implement a variety of security measures to prevent accidental loss and the unauthorized use and disclosure of your personal information. We cannot guarantee or warrant the security of any information you disclose or transmit to us online and are not responsible for the theft, destruction, or inadvertent disclosure of your information. Any transmission of personal information is at your own risk. We recommend that you take steps to protect the privacy and security of your personal and payment information and your activity while using the internet.
What Choices Do You Have About Our Use of Your Information?
Your information will be retained in our database for the purposes set forth in this Privacy Policy. Public accessibility to your account may be revoked at any time by submitting a request at privacy@mypowerpak.com. Your information will be stored for only as long as necessary, thus the retention period for your information will vary depending on your interactions with us (for example, where you have made a request to us via our Products, we will keep a record of your request for the period necessary to ensure the adequate provision of services to you). We will keep a record of your request for as long as necessary to protect us from a legal claim.
To determine the appropriate retention period for your information, we consider the sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purpose(s) for which we process your information, whether we can achieve those purposes through other means, and the applicable legal requirements. If you request it, we will provide you with a copy of your information. You may also send us an email at privacy@mypowerpak.com to request a correction or deletion of any personal information that you have provided to us. If we determine the change would violate law, legal requirements, internal policy, or cause the information to be incorrect, we may not be able to accommodate your request.
Location of Data
We are headquartered in the United States. We may have entities, operations and service providers in the United States and throughout the world. We and our service providers may transfer your information to, or access it from, countries other than the one in which you are located. These countries may have data protection laws different from those of the country which you are located. We will maintain appropriate administrative, physical, and technical safeguards to ensure an adequate level of protection of the information, you consent to the use and processing of your information within the US.

Our Products contain links to and from the websites of our partner networks, advertisers, and affiliates, including third-parties from whom you may choose to purchase items. If you follow a link to any of these websites or purchase products from any of these third-parties, please note that these websites and third-parties have their own privacy policies and terms of use and that we do not accept any responsibility or liability for these third-parties. Please check these policies and terms of use before you submit any information to these third-party links.
Changes to Our Privacy Policy
This Privacy Policy is effective as of the date set forth above. If we decide to change our Privacy Policy, we will update the “Last Updated” date on the Privacy Policy, post those changes at the URL, and provide further communication to you as required by law. We encourage you to review this Privacy Policy periodically.
Your California Privacy Rights
California Civil Code Section § 1798.83 permits users of our Products that are California residents to request certain information regarding our disclosure of personal information to third-parties for their direct marketing purposes. The service does not respond to browsers' Do Not Track Signals.
